With several problems I would recommend contacting Google for a replacement.

The reason you can't boot to recovery is because there is a bug in the Android 4.1.1, it has been fixed in 4.1.2 though.

I'm not sure, I live in the UK and consumer rights are different.
Start with the point of sale, you'll get an answer whether they will or if it's up to Google.

I would return it to the retailer if it fits into their policy. Exchange it for another.

Since you bought it yesterday, I'd go back to the retailer, but they may still direct you to Google, as they typically do.  Out of curiosity, were you trying to root it?  If so, you want to make sure you relock the boot loader, and unroot, because if it does have to go back, Google will not honor the warranty if these items were done.
